The Terms of Use (hereinafter referred to as the “Terms”) set forth the matters to be observed by the Registered Users as well as the rights and obligations of The Association of Medical Image Education (hereinafter referred to as the “Association”) and the Registered Users with respect to the use of The Journal of Typical Medical Images and Videos (JTMIV) provided by the Association. Every user desiring the registration for the service will be required to read through the entire text of these Terms carefully before agreeing thereto. (N.B. Japanese version is controlling. This English version is for reference only.)

Article 1 - Applicability

1.1 The purpose of these Term is to set forth the terms and conditions for providing the Service (as defined in Article 2) and the rights and obligations between the Association and the Registered Users (as defined in Article 2), and these Terms shall apply to all aspects of the relationship between Registered Users and the Association in connection with the Service.
1.2 Any rules and guidelines for use of the Service posted on our Website (as defined in Article 2) shall constitute an integral part of these Terms.
1.3 If there is any conflict between these Terms and the rules mentioned above or any other description of the Service not provided for herein, these Terms shall prevail.

Article 2 - Definitions

For the purposes of these Terms, the following terms shall have the meanings ascribed to them as follows:
(1) “Intellectual Property Rights” shall mean the copyrights, patents, utility model rights, trademark rights, design rights and any other intellectual property rights including, without limitation, the rights to acquire these rights or to file an application for the registration of any of such rights.
(2) "Our Website" shall mean such website as may be from time to time operated by the Association, whose domain name is [reserachmind.jp/thejtmiv.com] (or if such website's domain name or content has been modified for any reasons, such modified website).
(3) “Registered User” shall mean an individual or a corporation who is registered as a user of the Service in accordance with the provisions of Article 3.
(4) “Service” shall mean any and all services provided by the Association under the name “The Journal of Typical Medical Images and Videos (JTMIV),” which provides an online medical journal and collects medical images and videos containing time-series data of various diseases whose purpose is to publicize the medical images and videos uploaded by Registered Users and to make them available, for a fee, to Registered Users who desire to download and use the same (if such name or the content of such services has been modified for any reasons, such modified services shall be included).
(5) “Post” shall mean an action where the Registered User who agrees to these Terms transmits any data with the required information for posting designated by the Association or the image data attached thereto.
(6) ”Posted Users” shall mean the users who have submitted their content.
(7) "Posted Data" shall mean any content, including but not limited to text, images, videos and other data, provided by the Registered User through the Service, and any other information that the Association acquires from the Registered User including, but not limited to the evaluation or comments on the content, handle name of the user who posted the information, text, images, comments or e-mail address and other personal information.
(8) “Service Agreement” shall mean the agreement to be executed between the Association and the Registered User pursuant to Article 3.3 with respect to the use of the Service under the provisions of these Terms.

Article 3 - Registration

3.1 Registered Users are limited to the licensed health care workers (e.g. doctors, dentists, pharmacists, nurses, midwives, registered dietitian, clinical technologists, medical radiologists, clinical engineers, dental hygienists, physical therapists, occupational therapists, dental technicians, emergency medical technicians, speech-language pathologists, and orthoptists) or students who learn in specialized facilities for obtaining these national licenses.
3.2 Any person who desires to use the Service (hereinafter referred to as the “Applicant”) may apply to the Association for the registration as a user of the Service by agreeing to abide by these Terms and providing the Association with the information required by the Association (hereinafter referred to as the “Registration Information”) in a manner specified by the Association.
3.3 The acceptance or rejection of applications for the registration will be determined by the Association in accordance with the criteria established by the Association. The registration of an Applicant as a Registered User shall be deemed to have been completed when the Association issues to the Applicant a notice stating that the application has been accepted.
3.4 The completion of the registration under the preceding paragraph constitutes the execution of the Service Agreement between the Registered User and the Association with respect to the use of the Service in accordance with the provisions of these Terms, whereby the Registered User shall be entitled to use the Service in such a manner as specified by the Association from the date of the completion of the registration.
3.5 In the case that any reason in each of the following paragraphs is relevant to the Applicant, the Association may reject registration and not be held responsible for disclosure of the reasons:
(1) When the Registration Information submitted to the Association contains, in whole or part, false or erroneous statements or omissions;
(2) When the Applicant is an adult ward, a person under curatorship or a person under assistance, and has not obtained the necessary consent of his/her respective legal representative, guardian, curator, or assistant;
(3) When the Association determines that the Applicant is part of antisocial forces (which mean gang groups, gang members, right-wing groups or other similar entities; the same shall apply hereinafter), or the Association determines that the Applicant is associated with or involved in antisocial forces in any manner such as cooperating or engaging in maintenance, operation, management of antisocial forces through funding, or any other method:
(4) When the Applicant was determined to have been in violation of any agreements with the Association or to have involvement with a defaulting party of any such agreement;
(5) When the Applicant has suffered any of the measures under Article 13 (Prohibitions); or
(6) In addition to the foregoing, when the Association determines that the registration would be inappropriate.

Article4 - Changes in Registration Information

In the event of any change in the Registration Information, the Registered User shall promptly notify the Association of such change in accordance with the procedure specified by the Association and submit the information requested by the Association.

Article 5 - Management of Password and User ID

5.1 The Registered User shall be fully responsible for the security and safekeeping of passwords and user IDs, and the Registered User shall not cause or permit any third party to use the password or user ID nor shall it loan, assign, or cause to be owned in the name of another person or to be sold or purchased the password or user ID.
5.2 The Registered User shall be responsible and liable for any damage incurred by the Registered User as a result of inadequate management, wrong or improper use, or the use by a third party of the password or user ID. In no event shall the Association be responsible or liable for such damage.
5.3 In cases where the password or user ID is found to be stolen or used by a third party, the Registered User shall immediately notify the Association to that effect and follow the instructions provided by the Association.

Article 6 - Use of Service

During the time the registration as a Registered User is effective, the Registered User shall have the right to use the Service in such a manner as directed by the Association in accordance with, and within the scope of, these Terms.

Article 7 - User Fees

7.1 The user fees shall be as set forth in the Table of Fees.
7.2 For the user fees set forth in the preceding paragraph, the Registered
User is required to make a full payment through credit card.
7.3 The user fees will not be reduced or refunded for any reason, except as otherwise expressly stipulated herein
7.4 The Association may amend the user fees and billing method for the Service at any time by giving prior notice to Registered Users through any means of notice the Association deems appropriate. For the details of such amendments, the Association may, instead of giving notice to Registered Users, post on the Association’s Website.

Article 8 - Term of Service

8.1 The term of the Service shall be one (1) year from the date the Registered User has paid user fees set forth in the preceding Article.
8.2 If the Registered User cancels the Service Agreement during the term of the Service, the Association will not refund any fees already paid.
8.3 The term of the Service shall be automatically renewed for another year on the same terms and conditions if the Registered User fails to express the intention to refuse renewal prior to the expiration date of the Service, and the same shall apply thereafter.

Article 9 - Deletion and Modification of Posted Data

9.1 With respect to the Posted Data publicized in this Site, the Association reserves the right to modify or delete such Posted Data if, after such publication, the Association deems it necessary to do so, by giving the prior notice to the Posted User. If such modification or deletion of the Posted Data inflicts any damages to the Posted User, the Association shall not liable to compensate for such damages.
9.2 The Posted User may, at any time, modify or delete personal Posted Data.

Article 10 - Rights to Use; Copyright of Posted Contents

10.1 The copyright in the Posted Data uploaded to the Service shall be owned by the Posted User, and the Association does not acquire such right. However, by using the Service, the Posted User hereby grants the Association a perpetual, royalty-free, worldwide right and license to use the Posted Data, and the Association acquires such right to use.
These rights to use include the rights of reproduction, public performance, public display, public transmission, public recitation, public exhibition, distribution, transfer of ownership, public rental, translation and adaptation, and the rights of alteration to the extent that the Association deems necessary for business purposes, and the rights specified in Articles 27 and 28 of the Japanese Copyright Act, and include the rights to sublicense these rights to third parties.
The rights to use the Posted Data on our Site will not be affected by the edition or deletion of such Posted Data by the Posted User or the termination of the Posted User’s registration of the Service in any way.
10.2 For the case stipulated in the preceding paragraph, users agree beforehand not to exercise their moral right as authors against the Association or any third party designated by the Association to the extent specified in the preceding Article 10.1.
10.3 Users of the Service shall NOT use the Posted Data of the Posted Users beyond the scope of the intended use the Association reasonably expected in the Service (including but not limited to copying, transmission, reproduction, modification), except for the case previously approved by the Association. Other terms of use of the Posted Data shall be subject to the Terms of Use of Posted Data separately set forth by the Association.
10.4 The Association may check the details of the Posted Data, when the Association deems it necessary to verify their compliance with relevant laws or regulations or these Terms. However, the Association is NOT obligated to conduct such investigations.
10.5 If any third party reproduces the Posted Data without the permission of the Posted User through no fault of the Association, the Association shall not be held liable for any loss or damage that the Posted User may suffer therefrom.

Article 11 - Content of Posting

11.1 The Posted User may not post the material or expressions that the Association deems inappropriate. In such case, the Association may take any action, including removing the said Posted Data or suspending or cancelling registered account without prior notice to the Posted User, and the Posted User may not state any objection against such action.
11.2 In addition to the foregoing provision, when positing the data, the Posted User shall comply with the Guidelines for Authors separately set forth by the Association.

Article 12 - License to Use Posted Data

The Registered User may use the Posted Data published on the Site in accordance with the Terms of Use of Posted Data separately set forth by the Association.

Article 13 - Prohibitions

When using the Service hereunder, the Registered User may not conduct any of the following acts:
(1) Acts that send and upload any false information;
(2) Acts that falsify or delete information available in the Service or that attempt to do the same;
(3) Acts that infringe copyrights, trademarks, or any other intellectual property rights of any third party or the Association or other rights of others by violating the right designed to protect an individual’s name, image, or likeness or honor;
(4) Acts that discriminate or slander another person or acts that injure honor or reputation of learners or other third parties or of the Association;
(5) Acts that infringe or that may infringe the property, privacy, likeness, or publicity rights of a third party;
(6) Acts of transmitting advertisements, propaganda, solicitations, and the like through electronic mail without permission or transmitting electronic mail that bears feelings of disgust or may cause such feelings (harassment e-mail), acts that disturb the e-mail reception of other users, acts of requesting the forwarding of chain mail, and acts of forwarding chain mail in response to said requests;
(7) Acts that inflict damage, including but not limited to bodily injury, mental damage or economic loss on other Posted Users;
(8) Acts related to crimes such as fraud;
(9) Acts that establish pyramid selling schemes or acts that solicit the same;
(10) Salesorsolicitationoffollowinggoodsorservices:
a. Sales or solicitation of products or services of the specific operators;
b. Sales and solicitation of specific financial instruments or investment methods;
c. Solicitation of loan or debt arrangement;
d. Sales or solicitation of matching services by bonding with unacquainted strangers for marriage or encountering unacquainted persons;
e. Sales or solicitation of other goods or services that are not necessary for the course;
(11) Advertising, marketing, promotion, electoral campaigning for public office, inducement into a specified thought or religion, or other similar content, acts of using or soliciting for other people to use harmful computer programs such as computer virus;
(12) ActsofdisguisingoneselfasanotherpersoninordertousetheService.
(13) Acts that access or attempt to access the other computer system or network connected with the Service improperly;
(14) In addition to those mentioned above, acts of violating laws and regulations or these Terms or acts contrary to public order or morals (including, but not limited to, prostitution, violence and brutality);
(15) ActsofsharingIDorallowingmultipleuserstousethesameID;
(16) Unless specifically authorized by laws and regulations, acts that copy or otherwise reproduce, reprint, transmit, assign, distribute, disseminate, resell the information provided by the Posted Users and the Association or store it to use for these purposes without the prior permission of the Association;
(17) Acts that, directly or indirectly, evoke or facilitate acts listed in the preceding items; or
(18) OtheractsthattheAssociationdeemstobeinappropriate.

Article 14 - Use of Posted Data

14.1 The Association shall use the provided Posted Data in the Service after having confirmed that they do not violate any copyright, portrait, or other rights of third parties and that personal information has been deleted.
14.2 The Posted User shall submit Posted Data after having confirmed that they do not violate any copyright, portrait or other rights of third parties and that personal information has been deleted.
14.3 In the event that there arises an assertion of right, objection, complaint, or claim for damages from a third party in relation to the Posted Data, the Association shall take primary action with the third party, and actions to take thereafter shall be determined in consultation between the Association and the poster.
14.4 In the case of the preceding paragraph, where a legal claim is made by the third party against the Association, or the Association incurs damage, the Posted User who has caused the damage shall bear the expenses required for taking measures and any damage incurred by the Association on condition that the claim or damage has been caused by intentional act or gross negligence of the Posted User.

Article 15 - Third Party Advertisers

The Association may allow third party advertisers to advertise on the Site at their request. The Association undertakes no responsibility for the user’s dealings with any third party advertisers, including communication, participation in such advertising activities and transaction relating thereto. We shall not be responsible for any loss or damage incurred by the users of the Site in connection with the advertisements any third party advertisers posted on the Site.

Article 16 - Discontinuation or Suspension of the Service

16.1 In the event of any of the following circumstances, the Association shall reserve the right to permanently discontinue or temporarily suspend all or part of the use of the Service without prior notice to the Registered User:
(1) When the Association conducts scheduled or unscheduled inspections or maintenance of the computer systems relating to the Service;
(2) When a computer or telecommunications network ceases to operate or function as a result of an accident;
(3) When the operation of the Service becomes difficult due to fire, power failure, natural disaster, or any other cause of force majeure; or
(4) When for any other reason the Association determines that the discontinuation or suspension will be necessary.
16.2 The Association may, in its discretion, terminate the provision of the Service. In this case, the Association shall give prior notice to the Registered User.
16.3 The Association shall not be responsible or liable for any damage incurred by the Registered User as a result of any action taken by the Association in accordance with this Article 16.

Article17 - Ownership and Intellectual Property Rights

All ownership rights and Intellectual Property Rights in and to our Website and the Service shall vest in the Association or its licensors, and the use of the Service permitted through the registration under these Terms shall not be construed as granting any license with respect to our Website and the Service under any Intellectual Property Rights held by the Association or its licensors.

Article18 - Cancellation of Registration

18.1 If the Registered User falls under any of the following items, the Association may temporarily suspend the use by the Registered User of the Service or cancel the registration of the Registered User without any prior notice (hereinafter referred to as the "Suspension of Use"). Regardless of whether the cause of the Suspension of Use is attributable to the Registered User, the Association may, at its sole discretion and judgment, carry out the Suspension of Use and has no obligation to disclose the reason thereof to the Registered User. The Association shall in no event be responsible or liable for any damage incurred by the Registered User as a result of the Suspension of Use.
(1) If the Registered User violates any provision of these Terms;
(2) If the Registration Information is found to contain false information;
(3) If the payment of the Registered User’s debts is suspended, the Registered User becomes insolvent, or an application for a proceeding for bankruptcy, civil rehabilitation, corporate reorganization, special liquidation, or other similar proceedings is instituted with respect to the Registered User;
(4) If the Registered User has not used the Service for six (6) months or more and has not responded to any communication from the Association;
(5) If the Registered User falls under any of items of Article 3.5; or
(6) If the Association determines for any reason that the continuation of the registration of the Registered User would be inappropriate.
18.2 In cases where the Registered User falls under any of items of Article 18.1 above, any and all monetary debt of the Registered User to the Association shall be automatically accelerated and become forthwith due and payable, and the Registered User shall immediately pay such monetary debt in full.

Article 19 - Disclaimer of Warranty and Exclusion

19.1 The Association makes no representation or warranty of any kind, express or implied, with respect to the Posted Data provided by the Service. If any error in the content of the Posted Data is pointed out or in any other case that the Association deems necessary, the Association may urge the Posted User to update the data, when appropriate, but the Association has no obligation to do so.
19.2 The Registered User shall investigate at his/her own expense and responsibility to determine whether or not his/her use of the Service will violate any law or regulation applicable to the Registered User or the internal rules of the entity of which the Registered User is a member, and the Association makes no warranty that the use of the Service by the Registered User will comply with the laws and regulations applicable to the Registered User and the internal rules of the entity of which the Registered User is a member.
19.3 The Registered User shall, with his/her full responsibility, treat and resolve all transactions, communications, disputes, etc., in connection with the Service which arise between the Registered User and other Registered Users or any third party, and in no event shall the Association be responsible or liable for the same.
19.4 In no event shall the Association be responsible or liable for suspension, discontinuation, unavailability, or modification of the Service caused by the Association, deletion or loss of any message or information from the Registered User, cancellation of the registration of the Registered User, loss of data or failure of or damage to equipment through the use of the Service, or any other damage incurred by the Registered User in connection with the Service. Notwithstanding any disclaimer in this Article or other provisions herein, when the Association shall be liable for the damage of the Registered User due to the Consumer Contract Act in Japan or other reason, the liability of the Association shall be limited to the amount of ¥10,000 (ten thousand yen), only in the case that such damage was caused by the Association's willful misconduct or gross negligence.
19.5 Even if the Service contain links to and from other websites on the Internet, the Association shall not, for any reason, be responsible for any such websites or any information obtained therefrom.

Article 20 - Compensation for Damages

If the Registered User damages the Association as a result of any violation of these Terms or in connection with the use of the Service, the said Registered User shall compensate such damage to the Association.

Article21 - Confidentiality

21.1 For the purposes of these Terms, the “Confidential Information” means any and all information related to technology, business, operation, finance, association, etc., of the Association that may be provided or disclosed by the Association to, or come to the knowledge of, the Registered User in connection with these Terms or the Service in writing, orally, or in storage media, etc., but excluding information (1) that is generally available to the public or known to the Registered User at the time when the information is provided or disclosed by the Association to or comes to the knowledge of the Registered User, (2) that becomes publicly known through publication or otherwise without fault of the Registered User after the information is provided or disclosed by the Association to or comes to the knowledge of the Registered User, (3) that the Registered User has lawfully acquired without any obligation of confidentiality from a third party authorized to provide or disclose the information, (4) that the Registered User has developed independently of the Confidential Information, or (5) that is confirmed by the Association in writing to be excluded from the obligation of confidentiality.
21.2 The Registered User shall use the Confidential Information of the Association solely for the purpose of using the Service hereunder, and shall not provide, disclose or divulge the Confidential Information of the Association to any third party without the Association’s prior written consent.
21.3 Notwithstanding the provision of Article 21.2, the Registered User may disclose the Confidential Information of the Association when such disclosure is required by law or by an order, requirement or request of a court or governmental authority; provided, however, that such order, requirement or request shall be promptly notified to the Association by the Registered User.
21.4 At any time upon request of the Association, the Registered User shall at any time return to the Association or destroy the Confidential Information of the Association and the documents or other storage media containing or including the Confidential Information along with all reproductions thereof without delay in accordance with the instructions of the Association.

Article22 - Treatment of User Information

Treatment by the Association of the Registered User’s information shall be subject to the provisions of the Privacy Policy which are separately prescribed by the Association, and the Registered User hereby agrees to treatment by the Association of the Registered User’s information subject to such Privacy Policy.

Article 23 - Withdrawal

23.1 The Registered User may withdraw from the Service and cancel its registration as a Registered User by giving notice to the Association to that effect and pursuant to such manner as specified by the Association.
23.2 The Registered User acknowledges beforehand that even if the Service Agreement terminates, the Posted Data and comments thereto shall not be deleted, provided, however, that if the Registered User desires to delete his/her Posted Data, it is possible to carry out these procedures before withdrawal.
23.3 Treatment of user information after the withdrawal shall be subject to the provisions of Article 22.

Article 24 - Effective Term

During the period of the provision of the Service, the Service Agreement shall become effective on the date of the completion of the registration pursuant to Article 3 in respect of the Registered User, and remain in force and effect between the Association and the Registered User until the termination of the registration of the said
Registered User.

Article25 - Amendment and Changes to Terms

25.1 The Association reserves the right to make amendment or change to the contents of the Service without restriction.
25.2 The Association reserves the right to make amendment or change to these Terms (including, without limitation, the rules and regulations concerning the Service which may be posted on our Website; the same shall apply hereinafter in this Article 25.2) at any time. In the event of any amendment or change to these Terms, the Association shall notify the Registered User thereof. If the Registered User uses the Service, or fails to take steps to cancel its registration within the time specified by the Association after the notice set forth above, the Registered User shall be deemed to have agreed to such amendment or change to these Terms.

Article26 - Communication and Notice

Any inquiries with respect to the Service or other communications or notices from Registered Users to the Association, or the notices concerning any amendment to these Terms or other communications or notices from the Association to the Registered User shall be made in accordance with the procedures specified by the Association.

Article27 - Assignment of Terms

27.1 The Registered User shall not assign, transfer, grant security interests on or otherwise dispose of the status under the Service Agreement or rights or obligations under these Terms without the prior written consent of the Association.
27.2 In cases where the Association has assigned the business regarding the Service to a third party, the Association may, as part of such assignment of business, assign to the third party assignee its status under the Service Agreement, its rights and obligations under these Terms, and the Registration Information and other information relating to the Registered User, and the Registered User hereby agrees to such assignment in advance. For the purposes of this Article 27.2, the assignment of business referred to above shall include, in addition to the usual form of assignment of business, split of the Association or any other form of restructuring of the Association which would result in a transfer of the business.

Article28 - Severability

If any provision of these Terms or part thereof is held to be invalid or unenforceable under the Consumer Contract Law of Japan or other laws or regulations, the remaining provisions hereof shall remain in full force and effect, and the Association and the Registered User shall endeavor to agree to an amendment thereof to the extent necessary to make such invalid or unenforceable provision or part thereof legally operative in order to achieve the same purpose and same legal and economic effect as originally contemplated by such invalid or unenforceable provision or part thereof.

Article29 - Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. Any and all disputes arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the Osaka District Court in Osaka, Japan, as the court of first instance.

Article30 - Resolution Through Discussion

Any matters not provided for in these Terms or those giving rise to any doubts with respect to the interpretation of these Terms shall be promptly resolved through consultation between the Association and the Registered User in accordance with the principle of good faith.

1-year subscription 10000 JPN yen (about 85 US dollars)
Students for medical doctors can subscribe the JTMIV free of charge by showing their school identification card or submitting a certificate indicating that they are medical students and will become medical doctors, with a institutional letter head and signature of their supervisors.

The Journal of Typical Medical Images and Videos (JTMIV) is a service offered by The Association of Medical Image Education (hereinafter referred to as the “Association”) to provide an online medical journal that collects medical images and videos containing time-series data of various diseases whose purpose is to publicize the medical images and videos uploaded by the registered users (hereinafter referred to as the “Posted Data”) and to make the Posted Data available, for a fee, to the registered users who desire to download and use the same.
The Posted Data on this Site may be used in accordance with the following terms and conditions of these Terms of Use of Posted Data (the “Terms”). By downloading the Posted Data, the users (“Users”) are deemed to have agreed to these Terms. (N.B. Japanese version is controlling. This English version is for reference only)

Article 1. Permitted Uses

1. The Association grants Users the non-assignable and non-exclusive license to use the Posted Data downloaded by Users. Users acknowledge in advance that the same or similar data has been or could have been used by a third party.
2. Users may use the downloaded Posted Data for the following educational purposes only (limited to the purpose that does not fall under the Prohibitions specified in Article 2):
- Preparation of teaching or training materials;
- Academic presentations;
- Writing of textbooks; and
- Writing of papers.
3. When using the downloaded Posted Data, Users must attach the marks specified by the Association (e.g. our site’s logo, case ID, etc.) and may not remove these marks.
4. Users agree and acknowledge that the Posted Data may be altered or deleted by Users who posted the said Data or the Association. The Association shall not be held responsible for any damage that may be suffered by Users as a result of such alteration or deletion of the Posted Data.
5. When editing (e.g. cutting off or trimming) the downloaded Posted Data, both the case ID of the original Posted Data and JTMIV’s URL should be attached.
6 Users may use the downloaded Posted Data by multiple media and in different ways at the same time.

Article 2. Prohibitions

Users may not use the downloaded Posted Data for the following purposes. If there is any doubt whether the act falls under any of the following prohibited acts, please contact the Association.
1. To use the Posted Data for commercial purposes (meaning any use that is intended for or directed towards commercial advantage or private monetary compensation);
2. To re-sell, distribute, assign, lease, or transmit the Posted Data to any third party regardless of commercial or non-commercial purpose, or to assign, lease, or pledge the right to use the Posted Data to any third party;
3. To produce or sell a similar service to this service or a similar product to the Posted Data to any third party by misappropriating the Posted Data;
4. To edit (cut off or trim) the Posted Data without attaching the Case ID of the original Posted Data and JTMIV’s URL;
5. To use the Posted Data for purposes contrary to public order or morality, or to use for the benefit of pornography, adult-oriented industry, fraudulent business practices, adult-oriented affiliate networks, online-dating sites, or antisocial groups, regardless of whether such use is contrary to public order or morality;
6. Notwithstanding the User’s deregistration (regardless of reasons for deregistration), to continue using the Posted Data that was downloaded while such User’s membership account being effective in a new way or by new media.
7. To use the Posted Data contrary to the limitations specifically set forth for each Posted Data.

Article 3. Use without Permission

1. If Users use the downloaded Posted Data beyond the scope of use set forth in Article 1 without obtaining prior permission of the Association, such Users shall be responsible for any loss or damage that may be incurred by the Association (including court costs and legal fees) in addition to the regular user fees set forth in Article 4.
2. In case of the preceding paragraph, Users shall, at the request of the Association, disclose every matter required by the Association including, but not limited to, name, address, phone number, and person in charge of a third party.

Article 4. Fees and Payment

1. The user fees shall be as set forth in the Table of Fees. For the avoidance of doubt, fees for use without making prior application or obtaining prior permission under these Terms shall be the applicable amount set forth in the Table of Fees.
2. For the user fees set forth in the preceding paragraph, Users are required to make a full payment through credit card.
3. The user fees will not be reduced or refunded for any reason, except as otherwise expressly stipulated herein.
4. If Users have delayed payment of the user fees set forth in the preceding paragraph, Users shall pay the Association the late payment penalty at a rate of 14.6% per annum incurred from the day following the due date up to the day of complete payment of such total amount.
5. The Association may amend the user fees and billing method for this service at any time by giving prior notice to Users through any means of notice the Association deems appropriate. For the details of such amendments, the Association may, instead of giving notice to Users, post on the Association’s Website.

Article 5. Return of Data and Refund

1. If the Association determines that the Posted Data downloaded by Users has been damaged due to a cause attributable to the Association and Users notify the same within two days computed from the date of receipt of the said data, the Association will provide prompt refunds. Provided, however, that, if Users fail to notify the Association within the time limits set forth above, the Association may deem that the Posted Data has not been damaged and there has not existed an incorrect order.
2. Except for the preceding paragraph, for the misdownloading due to any cause attributable to such User, the Association will not issue a refund.

Article 6. Disclaimers

The Association pays careful attention to the quality control of the Posted Data, but the Association provides no warranty with respect to any of the following, the Association is under no obligation to become involved in disputes between Users and any third party, and the Association is not liable for any damage arising from any of the following events:
1. Loss and damage and disputes between you and any third party that have occurred since the User fails to confirm, at his/her responsibility, the content of the Posted Data (direction of image, color, contrast) and description attached thereto prior to using the downloaded Posted Data.
2. Loss or damages, disadvantages or liabilities that arise from the disputes between the User and any third party about the content of information transmitted or provided by the User through the product created by using the downloaded Posted Data or the damage caused by such product.
3. Loss or damage, disadvantage, or liabilities that arise from the User’s use of the Posted Data in a manner or for a purpose contrary to these Terms and continual use of the Posted Data after the notice from the Association that the use of the said Posted Data should be stopped.
4. Impact of virus and data corruption to the User’s terminal device, communication equipment, and storage medium that has arisen or may arise from the use of the Posted Data on the Association’s site.

Article 7. Disputes with Third Parties

If Users incur any damage due to intentional misconduct or negligence of the Association, the Association shall compensate for damages suffered by Users, subject to the limit of the applicable user fees.

Article 8. Copyright and Other Rights

The copyright and other intellectual property rights in the Posted Data licensed to use to Users (including images, videos, description attached thereto, keywords, or any other related information) shall be owned by Users who have licensed the said Posted Data from the Association, and no copyright or other intellectual property rights shall be granted to Users who have used the said Posted Data.

Article 9. Termination of License to Use the Posted Data

Where the User falls under any of the following items, the Association may forthwith cancel the license to use the Posted Data without giving notice or demand, and thereafter, the User cannot use the Posted Data in any way. In this case, the User agrees to destroy any Posted Data and its reproduction in accordance with the instructions from the Association and to compensate for damages suffered by the Association or any third party resulting from the act of such User. If the User uses the Posted Date in the course of business, the Association or institution the User belongs to agrees to compensate for such damages in lieu of the User. The Association shall not be liable for any damages or disputes arising between the User and any third party due to the limitation on, or suspension, discontinuation or termination of, the license to use, for any reason.
1. If the User violates these Terms;
2. If the application or registration information is found to contain false information;
3. If it is found that the qualification as a registered user had been cancelled in the past or the qualification as a registered user is being cancelled during the course of this service;
4. If the User dishonors any bill or check owing to lack of funds or suspends payment of debts;
5. If the User suffers judicial execution of civil judgment (kyosei shikko), attachment (kari sashiosae), preliminary injunction, (kari shobun), foreclosure sale (keibai), or seizure of the property due to the arrearage of taxes, levies and assessments (taino shobun);
6. If a petition for the commencement of bankruptcy (hasan), special liquidation (tokubetsu seisan), corporate rehabilitation (kaisha kosei) or civil rehabilitation (minji saisei) proceedings is filed by or against User;
7. If the User suffers administrative order to cease business operation, cancel business license or registration;
8. If the User’s financial situation is or likely to be getting worse;
9. If the User acts in a manner that may adversely affect the relationship of reliability with the Association;
10. If the User is an antisocial force, or other similar person or entity (“Antisocial Force”), or it is found that the User is involved in any illegal donation, threatening behavior, libel and slander actions, obstruction of the business, fraudulent activities, organized crime, or an unreasonable demand beyond legal responsibility;
11. If the User or the User’s officer has any interaction or involvement with an Antisocial Force, directly or indirectly by way of finance or other means, or it is found that the User or officer has provided funds to an Antisocial Force regardless of purpose or has conducted similar act; or
12. If the User appoints a person who belongs to an Antisocial Force or has a close connection with an Antisocial Force as a director or employ such person as an employee, or an Antisocial Force is involved in management.

Article 10. Amendment of Terms

Users agree and acknowledge that the Association reserves the right to change or amend these Terms at any time without prior notice. Such amended Terms shall be effective and apply to Users upon posting on this Site.

The Association of Medical Image Education (the “Association”) sets forth this Privacy Policy (this “Policy”) with regard to the treatment of users’ information, including but not limited to personal information, during the performance of services provided by the Association (the “Services”), as follows (N.B. Japanese version is controlling. This English version is for reference only);

1. User’s Information to be Collected and Method of Collection

For purposes of this Policy, “User’s Information” shall mean information that identifies users, history of actions on communication services, and other information created or accumulated in relation to the user or users’ devices, such as smartphones or PCs, which shall be collected by the Association pursuant to this Policy. Depending on the method of collection, the User’s Information that the Association may collect for a user to use the Services includes:
(1) Information provided by the user, including the following:
- Real name;
- E-mail address;
- Phone number;
- Address;
- Affiliated institution;
- Qualification;
- Other information entered by the user into such form as may be specified by the Association.
(2) Information provided from services outside the Services to the extent that the user permits for use with the Services
The Association may collect the following information from services outside the Services, including but not limited to social network services, to the extent the user permits for use with the Services at that time:
- ID used by the user for such outside service;
- Other information that the user has authorized the other service provider to disclose through its privacy settings in such outside service.
(3) Information collected by the Association for the use by the user of the Services
The Association may collect information upon access to or use of the Services, including the following:
- Terminal information;
- Log information;
- Cookies and anonymous ID;
- Location information.

2. Purpose of Use

The User’s Information may be used for the provision of the Services. Specific purposes of the User’s Information for the provision of the Services shall include the following:
(1) Provision, maintenance, protection, and improvement of the Services, including but not limited to acceptance of registration for the Services and identification of individuals;
(2) Guidance or response to inquiries relating to the Services;
(3) Addressing a violation of rules, regulations, or policies relating to the Services (the “Rules”);
(4) Notice of any modification to the Rules; and
(5) Other purposes incidental to the foregoing.

3. Method of Discontinuance of the Use

If the user specifies a certain setting, the user is entitled to require the Association to, and the Association shall immediately, discontinue the use of any or all of the User’s Information, in accordance with such rules as may be specified by the Association. Depending on the item of the User’s Information, if such collection or use is a prerequisite for the Services, the Association may not be able to discontinue such collection unless the user withdraws from the Services pursuant to the procedures as determined by the Association.

4. Provision of Personal Information to Third Parties

Unless required by the Personal Information Protection Act in Japan or other applicable laws and regulations, the Association shall NOT provide to any third party personal information contained in the User’s Information without the prior consent of the user, unless:
(1) The Association authorizes such third party to handle the personal information in whole or in part to the extent necessary to accomplish the purpose of the use.
(2) The personal information is provided through a business transfer by way of merger or other similar transactions.
(3) The Association is required to cooperate with state or local government organization or their agents to perform their duties or obligations pursuant to the applicable laws and regulations, and such performance is likely to be precluded if the consent of the user must be obtained.
(4) In addition to the foregoing, the Association is entitled to disclose information pursuant to the Personal Information Protection Act or other applicable laws and regulations.

5. Disclosure of Personal Information

Upon request from the user to disclose its personal information under the Personal Information Protection Act, the Association shall, without delay, disclose to the user such information after confirming its identity (or notify it of the non-existence of such personal information) to the extent required to do so pursuant to the Personal Information Protection Act and other applicable laws and regulations. Please note that you shall pay a commission (¥1000 per request) for disclosure of personal information in some cases.

6. Correction and Suspension of Use of Personal Information

6.1 If the Association is required by the user to (1) correct the content of personal information under the provisions of the Personal Information Protection Act because such information is false or (2) suspend use of personal information because such information is being handled beyond the scope of the purpose of the use previously made public or has been collected in a fraudulent or otherwise illicit manner, then the Association shall, without delay, conduct an appropriate investigation after confirming the requesting party’s identity, and based upon the results, correct the content or suspend the use of such personal information, and notify the party to that effect. The user shall also be notified of any determination, if applicable, not to correct or suspend the use of such information, together with the justification for such determination.
6.2 In the event that the Association is required by the user to delete its personal information and has determined that it is necessary to accept such request, the Association shall delete such personal information confirming the requesting party’s identity and shall notify the party to that effect.
6.3 Should the Association not be obligated to correct, or suspend use of information pursuant to the Personal Information Protection Act and other applicable laws and regulations, the preceding two paragraphs shall not apply.

8. Modifications to this Privacy Policy

The Association shall from time to time review how the User’s Information is being handled, and use its best efforts to continuously improve the operation, and make such modification to this Privacy Policy as may be necessary. Any modification to this Privacy Policy shall be notified to you by the manner specified by the Association; provided that for any modification requiring consent from the user, such consent must be obtained subject to the procedures as separately established by the Association.
